U.S. And Mexico Sign Poultry Safeguard Agreement
On July 25, the U.S. and Mexico jointly announced a special poultry safeguard agreement affecting only the export of U.S. chicken leg quarters to Mexico, thus avoiding a potential trade disruption for other poultry products. The Mexican border should reopen early this week to all imports of U.S. poultry; Mexico closed its borders to all poultry products on July 22 upon the expiration of a six-month provisional safeguard agreement between the U.S. and Mexico.
The safeguard on chicken leg quarters will be imposed until December 31, 2007, as a tariff rate quota. The quota amount will initially be 100,000 metric tons (mt) for the first year (2003), and will be increased by 1 percent each year that the safeguard applies. Approximately 47,000 mt of this year's quota remain. In-quota duty will be zero, while over-quota duty will initially be 98.8 percent. The duty is to be reduced on January 1, 2004, and each of the following four years in equal increments until the duty rate is zero on January 1, 2008.
The new safeguard agreement is significant because it affects only chicken leg quarters and not any other product, and because it was agreed upon by both the U.S. and Mexican poultry industries. It is not a renegotiation of the North American Free Trade Agreement (NAFTA); both governments agreed that it is allowable under existing NAFTA rules.
