Automated Export System (AES) Will Be Mandatory

The Automated Export System (AES), the electronic way to file the Shipper's Export Declaration (SED) and ocean manifest information directly to U.S. Customs, will soon convert from a voluntary system to a mandatory one with potentially heavy fines for noncompliance.

Currently the responsibility of the U.S. Census Bureau, AES is being transferred to the U.S Customs and Border Protection Service (CBP). An official change to AES was posted in the Federal Register June 2, announcing that its use is now mandatory and will be facilitated by Customs.   AES regulation will go into effect July 2, 30 days after the announcement was posted in the Federal Register.   There is a 90-day Informed Compliance Period which will end Sept. 30, 2008.   After that date, there will be strict compliance requirements with heavy penalties in the form of fines for violations.

Seminars are being held around the United States as well as webinars for training of U.S. shippers. There also are training seminars underway for customs inspectors.
