Australian Federal Court Issues Pork Ruling

The Federal Court of Australia has issued its ruling on Australian Pork Ltd v. Director of Animal & Plant Quarantine.

At this time we are attempting to fully understand the court’s ruling and what it means for future U.S. pork exports to Australia and what affect the ruling may have with regard to product on the water.

In a very preliminary, non-legal review of the ruling, it appears that there is no impact on existing permit holders, except for possibly Fayman International. It is uncertain what happens to product on the water but the existing 80 plus current import permits appear to remain valid.  However, it also appears there will not be any new permits issued.  Again, this reading is preliminary and we need legal review and are awaiting a statement from the Australian government. The government's appeal looks like it will go forward.
